HOLLAND DATED JUNE 27, 2007 Defendant, the United States, respectfully requests leave to file corrected deposition designations for the deposition of Homer J. Holland taken on June 27, 2007. We seek to file corrected transcript designations because our prior designations filed on November 17, 2007, were inadvertently not based upon the trial exhibit version of the deposition transcript for that day, but upon a preliminary draft of the deposition transcript of that deposition. Our error has resulted in deposition transcript designations from our deposition of Dr. Holland on June 27, 2007, that we did not intend to make. It has also resulted in understandable confusion on the part of plaintiffs (where, for example, a large number of our citations for that day begin or end mid-sentence when referenced against the final version of the deposition transcript). Accordingly, we seek leave to make the following corrected designations for the deposition transcript of Dr. Holland for June 27, 2007. To permit plaintiffs and this Court to follow the intended passages from the earlier version of the deposition transcript that we used to DX 1487, the trial exhibit version of the transcript (which, compounding our error, was attached

To demonstrate that we are changing the page and line cites but not the actual passage of testimony that we intended to designate, we have annexed, as Exhibit A, the preliminary version of the June 27, 2007 deposition transcript that we used in determining the deposition passage cites in our initial filing. Finally, we have annexed, as Exhibit B, the proper and truly final deposition transcripts from trial exhibit DX 1487 that correspond to our corrected deposition designations. For the foregoing reasons, we respectfully request leave to file these corrected deposition transcript passages from the deposition of Dr. Holland, taken on June 27, 2007. We have contacted plaintiffs' counsel and advised them of our intent to file this motion and they have informed us that, at this time, they neither consent to nor oppose our motion.
