ORDER

Pursuant to the telephone status conference held on September 26, 2007, the Court DENIES Defendant's Emergency Motion in Limine to exclude the supplemental report of Mr. Arthur H. Cobb. The Court GRANTS Defendant leave to depose Mr. Cobb. Further, the Court GRANTS Defendant's motion for enlargement of time to file its pretrial documents. The Government shall file its pretrial documents on or before October 5, 2007. Regarding Plaintiff's Motion in Limine to Exclude Testimony of Charles McKee and Reid Pixler, the Court finds that the motion as it concerns Mr. McKee is MOOT. The motion to exclude the testimony of Mr. Pixler is GRANTED. The Government may file an opposition to the Plaintiff's motion to exclude Mr. Pixler's testimony, and the Court will issue a separate written opinion. Further, the Court hereby RESCHEDULES the pre-trial conference by telephone for Wednesday, October 10, 2007 at 9:30 a.m. EST. Trial shall commence on Wednesday, October 17, 2007 at 9:30 a.m., for a duration of six days. The trial dates shall be October 17, 18, 19, 22, and 24, 2007. The trial shall take place in Courtroom #9, United States Court of Federal Claims.
