No. 97-579C (Judge Williams)

DEFENDANT'S REPLY IN SUPPORT OF ITS POST-TRIAL BRIEF In accordance with the Court's September 26, 2007 order, the United States respectfully submits this response to plaintiff's Post-Trial Reply Brief, dated February 26, 2008. Inasmuch as plaintiff has waived her right to respond to any of the arguments that we made in our PostTrial brief, we have no Post-Trial Reply Brief to which a response can be filed. Accordingly, we file no substantive Post-Trial Reply Brief and respectfully request that, for the unrefuted reasons contained in our Post-Trial Brief, the Court find that the United States is not responsible for any breach of contract with plaintiff and grant judgment in favor of the Government. Respectfully submitted, JEFFREY S. BUCHOLTZ Acting Assistant Attorney General s/ Jeanne E. Davidson JEANNE E. DAVIDSON Director
