ORDER SCHEDULING FURTHER SUPPLEMENTAL BRIEFING On October 4, 2006, the court conducted a recorded telephone conference with the parties, in which the parties gave oral arguments on issues raised in their supplemental briefs. The court requested that the parties articulate their positions in additional briefs submitted to the court. Accordingly, further supplemental briefing is scheduled as follows: 1. Plaintiffs may file no later than Friday, November 17, 2006 a supplemental brief, detailing their arguments raised during the telephone conference. 2. Defendant may file no later than Monday, December 18, 2006 a response to plaintiffs' supplemental brief. 3. Plaintiffs may file no later than Monday, January 8, 2007 a reply to defendant's response. The parties are asked, in particular, to focus on the factual issues relating to the federal, state and local permitting processes. IT IS SO ORDERED. s/
