JOINT STATUS REPORT Pursuant the parties' joint status report of July 2, 2008, the parties respectfully provide the following joint status report proposing an initial schedule for moving forward with this litigation.1 The parties respectfully propose that fact discovery close on January 15, 2009. The parties also respectfully propose that they file a status report proposing a further schedule for moving forward with this litigation, including expert discovery, on or before January 30, 2009.

Pursuant to the Court's order of December 12, 2005, the parties are filing an identical status report in Croman Corp. v. United States, No. 01-40C.
