PLAINTIFF'S UNOPPOSED MOTION FOR LEAVE TO FILE AND SERVE APPENDIX TO PLAINTIFF'S CROSS-MOTION FOR PARTIAL SUMMARY JUDGMENT AND OPPOSITION TO DEFENDANT'S MOTION FOR PARTIAL SUMMARY JUDGMENT IN PAPER FORM Pursuant to the Court's May 16, 2003 Notice of Designation in this case and General Order No. 42, Plaintiff Placid Holding Company ("Placid") respectfully requests leave of Court to file and serve the Appendix to its Cross-Motion for Partial Summary Judgment and Opposition to Defendant's Motion for Partial Summary Judgment in paper form rather than electronically. Placid will file its Opposition and Cross-Motion, due September 25, 2003, electronically and seeks leave only to file and serve the appendix in paper form. Defendant does not oppose this request. Placid seeks authorization to file and serve its appendix in paper form because Placid anticipates that its appendix will exceed 1,500 pages and will include over 100 separate documents. Electronically filing such extensive documentation would pose logistical difficulties. In addition, Placid believes that a paper form of the appendix will be much less cumbersome for the Court and the parties to access and utilize.
