UNOPPOSED MOTION TO AMEND THE APPENDIX FILED WITH DEFENDANT'S CROSS-MOTION FOR SUMMARY JUDGMENT AND OPPOSITION TO PLAINTIFFS' MOTION FOR SUMMARY JUDGMENT Pursuant to Rule 56(b) of the Rules of the United States Court of Federal Claims ("RCFC"), defendant, the United States, respectfully requests that the Appendix filed with our cross-motion for summary judgment and opposition to plaintiffs' motion for summary judgment be amended. It has come to the attention of the undersigned counsel that the electronic filing of the Appendix on December 21, 2007, inadvertently omitted Exhibit 32. Exhibit 32 consists of excerpts from the deposition of Wayne Coleman taken pursuant to Rule of the Court of Federal Claims 30(b)(6) on Nov. 2-3, 2006. Exhibit 32 is cited in footnote 8 of our brief and is cited extensively in the Defendant's Proposed Findings of Uncontroverted Fact and the Response to the Plaintiffs' Proposed Findings of Uncontroverted Fact. Counsel for the plaintiffs, Matt Dunn, indicated today via electronic mail that the plaintiffs do not intend to oppose this motion.
