THE UNITED STATES, Defendant. _________ ORDER __________ A telephonic status conference was held in this case on August 1, 2006. Participating in the conference were M. Todd Welty, on behalf of plaintiff, and Grover Hartt, III, on behalf of defendant. Pursuant to the discussion held therein, the court adopts the following schedule: (i) On or before August 31, 2006, the parties shall designate their expert witnesses; On or before October 31, 2006, the expert witnesses shall be deposed; and On or before December 22, 2006, the parties shall file simultaneous memoranda with the court including: a. A list of the expert witnesses to be called, including names, addresses, telephone numbers, the specific topics to be addressed, and an estimate of time needed to present their evidence. See, e.g., Appendix A, ¶ 13(b) of the Rules of the Court of Federal Claims (RCFC). A list of exhibits to be used at the hearing. See, e.g., RCFC App. A, ¶ 13(a).

Copies of the expert reports for the expert witnesses testifying at the hearing. See, e.g., RCFC 26(a)(2)(B).

(iv)

An evidentiary hearing will be held in this case at 10:00 a.m. (C.S.T.) on January 18, 2007, at the United States District Courthouse, 1100 Commerce St., Dallas, TX 75242. The courtroom location will be posted in the lobby of the courthouse on the day of the hearing.

The parties are reminded that the hearing and all testimony shall focus only on the applicability of 26 U.S.C. § 6501(e)(1)(A)(i), and that no expert shall opine on the ultimate issues before the court. IT IS SO ORDERED.
