DELPIN APONTE, et al., * * Plaintiffs, * * v. * * THE UNITED STATES, * * Defendant. * * *********************** ORDER In light of the memorandum opinion and order dated August 14, 2008, below is the briefing schedule for the parties' dispositive and other motions. An amended complaint, if to be filed at all, must be filed by plaintiffs on or by August 21, 2008. Defendant's answer would be due on or by August 28, 2008. The plaintiffs must file their motion for partial summary judgment on or by September 8, 2008. Defendant's opposition and cross-motion for summary judgment shall be filed on or by October 9, 2008. The plaintiffs' reply in support of their motion for partial summary judgment and opposition to defendant's cross-motion for summary judgment is due October 27, 2008. Defendant's reply in support of its cross-motion for summary judgment is then due November 17, 2008. The plaintiffs' motion for class certification is due on or by September 8, 2008. Further briefing shall follow the normal times for filing as laid out in Rule 7.2 of the rules of our court. A hearing on the parties' dispositive motions will be held on November 24, 2008 at the Howard T. Markey National Courts Building, 717 Madison Place, NW, Washington, D.C., beginning 10 a.m. Eastern Time.

The Court is amenable to changes in this schedule to convenience the parties. Counsel should feel free to confer and jointly propose any adjustments to the schedule to which they can mutually agree.
