MOTION FOR LEAVE TO FILE UNCONTESTED MOTION FOR EXTENSION OF TIME BEFORE THE HONORABLE COURT: COMES NOW Plaintiffs in the above captioned complaint and as further detailed, through undersigning counsel, respectfully STATE and PRAY: 1. On September 11, 2006, plaintiffs in the captioned case filed a motion named Uncontested Motion for Extension
of Time. Said motion was filed through the electronic filing system of the United States Court of Federal Claims. 2. Unbeknownst to undersigning counsel and due to unknown circumstances, when browsing the motion to be
filed through the system the signature page was not recognized and scanned by the system. Today, the Clerk of the Court made us aware of said omission. 3. 4. Attached to this motion a complete copy of the Uncontested Motion for Extension of Time. Undersigning counsel requests leave to file the Uncontested Motion for Extension of Time. Since the motion is
uncontested and was originally filed within the time period required under the rules, no harm or prejudiced is caused to defendants accordingly. WHERETOFORE plaintiff move the Court for leave to file the motion titled Uncontested Motion for Extension of Time dated September 11, 2006, and grant the same allowing plaintiffs to file their response on or before October 14, 2006.
