A. Introduction
These actions contest clai settlement provisions of the
Compact of Free Asociation (the "Compact"), an

'international,

agreement negotiated between the United States and the
R~public of the Marhal Islands (''Marshal Islands;') to

prehensivelý defie ~he diplomatic relations between the two
governments. The

Compact, approved by Marhal Islands

citizens and by the United $tates Congress, establishes a relationship of "free association." By its term, the United States recog-

nizes that the peoples of the Marhall Islands are self-governg,
and the Compact explicitly defies the governental, economic,
and security

and defense reiations between the tWo sovereign.

As an integral par' of thi agreement, the United States "accepts the responsibilty for compensation owig to citizens of the

Marhall Islands" for loss or damage resulting rrorn the nuclear
testig program which the United States conducted in the Northern Marshal Islands from June 30, 1946, to August 18, 1958 (App.

60 Stat. 755 et seq. The program included detonation of 23 atomic

Navy evacuated the 167 inabitants of Bik Atoll to Rongeri

Atoll, 150 mies east of Bik, prior to the fit series of tests,
known at Operation Crossoads (App. 121). In March 1948, the
Navy again moved the people of Bik to a temporar capsite

, on Kwajalein Atoll, and in September 1948 to the Island of Ki, 400 mies southeast of Bik (App. 123).
