No. 06-942 L (Filed January 18, 2008) ********************* PASSAMAQUODDY TRIBE, * * Plaintiff, * * v. * * THE UNITED STATES, * * Defendant. * ********************* ORDER On January 14, 2008, the court ordered the parties to confer and propose a date for an evidentiary hearing on defendant's Motion to Dismiss Pursuant to 28 U.S.C. ยง 1500. On January 17, 2008, the parties notified chambers of the undersigned that they had conferred and agreed upon February 1, 2008, for the court to receive testimony of Ms. Alexis Applegate. Accordingly, it is hereby ORDERED that: (1) An evidentiary hearing shall be HELD on Friday, February 1, 2008 at 10:00 a.m., eastern time, at the United States Court of Federal Claims, 717 Madison Place, N.W., Washington, D.C. The location of the courtroom will be posted on the directory in the lobby; Unless counsel agree otherwise, as the party bearing the burden of proof on the issue of the sequence of the filings of the complaint in the subject matter and the complaint in the district court, counsel for plaintiff shall initiate the direct examination of Ms. Applegate; No time limit shall be applicable to direct examination, but counsel will be afforded equal time and should bear in mind that all

proceedings, including any questions from the undersigned, should be concluded by or before 1:00 p.m., eastern time; and (4) Joint exhibits of documents, as required by the court's order of January 14, 2008, shall be provided in sufficient copies for counsel, the witness, the law clerk, the court reporter and the undersigned. Additionally, the court expresses a strong preference that the documents be tabbed and presented in a binder for ease of reference.
