I, Lachlan W. Seward, hereby declare, pursuant to 28 U.S.C. ยง1746, as follows:

I am currently employed by the United States Department of the Treasury, Office

of the Fiscal Assistant Secretary, as Project Manager, Indian Litigation. 2. As explained below, Treasury's plan for complying with the retention order in

this case is to continue following the retention plan Treasury put in place in March 2004 in response to the retention orders issued in Jicarilla Tribe v. United States, No. 020025L (C.F.C.) and Pueblo of Laguna v. United States, No. 02-0024L (C.F.C.) 3. As shown in the materials attached hereto at Tabs A through L, Treasury's

Jicarilla / Laguna retention plan was designed to retain materials potentially containing information related to any tribe, which would include the Kaw Nation. This was necessary because Treasury has few materials that refer to any specific tribe. Treasury
