76.2-mile railroad line in Cochise Coty, AZ, as follows (1) the Bisbee Brach, between

milepost 1085.0 at Bisbee Junction and milepost 1090.6 at Bisbee, a distace of 5.6 miles; (2) the Douglas Branch (a) between milepost 1097.3 near Paul Spur and milepost 1106.5 near
Douglas, a distance ot9.2 inles, (b) between milepst 1055.8 near 1097.1 near

Chleston and milepost

Paul Spur, a distance 01'41.5 miles, an (c) between milepost 104.l5 near Curs

and milepost 1055.8 near Charleston, a distace of 19.9 miles.

The Trut for Public Land (TPL) filed a request for a Notice öfInterim Trail Use condition regading the right of way by lett dated January 26, (N) and for a public use 2006, to perit TPL to negotiate an agreement with SPROC fór pure.hase of its subject nght of way for tril use. SPROC responded to TPL' s reuest by letter fied on July 20, 2006, indicating that it was willng to negotiate for trl use with TPL.
OnJuly 25, 2006, the Surface Transporttion Board (STB) found that TPL's request complied with the requirements of 49 CFR 1152.29. The STB imosed a public us condition, and issued a NITU for a peod of 180 days (i.e. until Janua 22,2007) for the

partes to negotiate an intem tral use/rail baning agreement.
TPL and SPROe are in the procss of completing negotiations of an option for TPL's
purchase of th porons of the subjectnght of way

tht is owned by SPROC in the-Douglas

Branch as follows: (a) between milepost 1040.15 nea Curtiss and milepost 1055.8 near 19.9 miles and (b) between milepost 1055.8 near Charleston and Charleston. a distance of the rail line with State Highway 92, a (approximately) milepost 1074.3 at the intersetion of distance of approximately 18.5 miles, (coIJectively the "Sdbject Right of Way").
