In the United States Court of Federal Claims
No. 07-285 L (Filed: November 1, 2007) ************************************* ELIP, LLC, * * Plaintiff, * * v. * * THE UNITED STATES, * * Defendant. * ************************************* ORDER On November 1, 2007, the court conducted a preliminary scheduling conference in the above-captioned case. The parties requested ninety days in which to conduct fact and expert discovery. Thus, discovery will close no later than Friday, February 1, 2008. Then, no later than Friday, February 15, 2008, the parties shall file a joint status report describing their progress and suggesting further proceedings. If defendant's expert requires additional time to prepare a report (as a result of defendant's probable inability to hire an expert before December 1, 2007, due to lack of congressional appropriation), defendant shall file the appropriate motion for enlargement. The court will look favorably on such a motion so long as defendant's enlargement request is reasonable. IT IS SO ORDERED.
