La Jars Fuels Reduction ProJêct

USDA Forest Service

Cibola National Forest
ML Taylor Ranger DistrIct Cibola County, New Mexico
It Îs my decision to thin 750 acres of small diameter (1"_12" díameter breast height) Ponderosa Pine,

Piñon and Juniper for the purpose of reducing the risk of catastrophic fire in the wildland urban interface and improving forest health and vigor. The project is located in the following area: along Forest Road 49 adjacent to the La Jara Subdivision and south of the La Jara Subdivision to a two
track road going from Forest Road 49 to Malpais Spring Area north of the La Jara Subdivision

boundary to Forest Road 491 T10N, A11W. section 7,8,17.18, and 19; T10N, R12W, section 12,13 and 24. The project area is located 10 miles southwest of Grants, New Mexico in the Zuni Mountains.

This decision fits Category # 6 (FSH 1909.151 Chapter31.2) and does not include any extraordinary
circumstances (FSH 1909.15, Chapter 30.3); therefore J have excluded this action from preparation of Impact Statement an Environmental Assessment or Environmental

This project is located within Management Area 8 and is in compliance with the Cibola Forest Plan.

The project was discussed in an interdisciplinary setting. The project was discussed during a public meeting for hazardous fuels reduction around Wildland Urban Interface area on November 30, 2000.

Previously closed or decommissioned (oblierated) roads used by the public and any non-system
travel-ways created by the publíci as a result of this project or which result from assooiated project

activities, will be closed and lor decommissioned as a part of this project. The closure and/or decommissioning wil be consistent wìth Best Management Practices.
An archeological survey wil not be done because trees wil be cut by hand with no burning after the mechanical treatment. The District archeologist has determined this project to be a non-undertaking.

A Biological Assessment and Evaluation (BAE) and a Neotropical Migratory Bird Analysis (NTMBA) (Report # 02-007) have been prepared for this project and are on file at the Mt. Taylor Ranger District
proposed species. The NTMBA concludes that no signifícant effects wil occur to the Highest Priority

Office. The BAE concludes that this project wil have no. effect on any threatened. endangered or
Migratory Birds identified in the New Mexico Bird Conservation Plan prepared by New Mexico Partners in Flight from this project. A Management Indicator Species (MIS) Effects analysis was also

prepared for this project and Îs on fie at the Mt. Taylor Ranger District Ofice.

The Forest Silviculturist has certified that no irreversible resource damage to soifs and watershed resources will occur. This certification is on fjle at the Mt. Taylor Ranger District Office.

RE: Property Damage Claim against the USDA Forest Service Dear

Mr. and Mrs. Briseno:

I have reviewed the information submitted with the tort claim in the amount of $19,705.00 you filed with the USDA Forest Service. Unfortunately, the documentation submitted with the claim does not support an. award in the amount you have requested.
UnderNew Mexico law,' the measure of damages for inj uries to real is determined by.comparing the difference between the fair 'market value of the property bef.òre and after the damage took place ~ Where temporary damage resul ts to the surface estatei but it can be repaired, then the damages are the cost of repair or restoration only to the extent that the cost of restoration does not exceed the value of the property. The justification you have provided for the amount of damages you
property

seek only relates to the actual replacement of the trees. whic.li
"wer'e èuf ~ . .

arproximately three acres involved.
At this

This -: amoun t' f arexceeds the fair market Value of thé

'time, I can only offer you $218.00 in settlement of this claim. This amount was determined by calculating the total stumpage value of the trees which were cut ($458.00) and then subtractingtlie value of the material as firewood ($240.00). i understand that Forest Service employees cut and stacked this wood next to your residence at your request.

If you can provide me with any additional information related to the fair market value of the property before and after this incident, I will gladly reconsider this claim. If you have any questions regàrding this matter, please do not hesitate to call
me at (505) 248 - 6006 _
