In response to these designations, and pursuant to the Court's January 14, 2008 Order, defendant, the United States, respectfully submits our designations of additional portions of these deposition transcripts that should in fairness be considered contemporaneously with plaintiffs' submissions, and our objections to the admissibility of these designated transcript excerpts upon

In its motion, AmBase conceded that a deponent's statements may constitute admissions pursuant to Fed. R. Evid. 801(d)(2) only if "the deponent is employed or retained by the United States at the time of the deposition." Pl. Mot. 8-9. Accordingly, we object to the use of any statements in the depositions of Ms. Maligaya, Ms. Hughes, Ms. Tama, and Messrs. Dittenhafer, Connell, Vigna, Midnich, Griffin, Held, Green, Hughes, Vordtriede as "admissions" pursuant to Rule 801(d)(2).
