This action came on for consideration of the defendant's motion to dismiss
‘ before the Honorable Alvin W. Thompson, United States District Judge.
The court considered the full record of the case including applicable principles
of law, and filed a ruling on the motion to dismiss. The court granted the motion to
dismiss with respect to pIaintiff’s claims against the defendant pursuant to 42
U.S.C. §‘l981 , and for intentional and negligent infliction of emotional distress.
The court granted the plaintiff leave to file within 30 days an amencledscomplaint
setting forth claims against former Commissioner Armstrong and Warden Acosta in . `
their individual capacities. _' ‘
Therefore, it is ORDERED, ADJUDGED and DECHEED that judgment be and is
