I, CAROLYN W. KONE, state under the pains and penalties of peij ury as follows:
I. I ain over the age of eighteen (I 8) and understand my obiigation when
making a statement to this Court under the pains and penalties of perj ury.
2. I counsel to Defendants in the above captioned matter.
3. Attached hereto as Exhibit A is a certitied copy of a deed for property
located at 292-30·¢l Wnaitey Avenue in New Haven, Connecticut, the property in which
Sherri Kiiiins headquarters were iocated in May 2003.
4. Attached hereto as Exhibit B is a certified copy ofthe City of New Haven
Assessofs deed snowing that the property has been continuously owned (inciuding in
May 2003) since its acquisition by DIM Enterprises, Inc.
5. Accordingly, in May 2003 the property was owned by DIM Enterprises,
Inc. and not by either plaintiff.
