The Plaintiff in the above captioned matter hereby objects to Oefendant`s l'vIotiou for
Sanetions dated February 2, EDU? claiming an uutruthful diselosure ofexpert witness in
connection with this case
An Order {Ooeket #l 53} was drafted hy the Court after a teleconference held with the
parties on Tuesday. October Iti. Efitto. The contents ot` that Order were pri maril;.-‘ that on or
before Novemher 9. Etltjtti. the i·‘1aintil`i`:-shall {A} provide Detendanfs eounsel with the
halancc of responses to the requests lor production and interrogatories propounded by counsel
lor the Detendant; (R) tile two motions to eompel relating to outstanding diseover;v in Texas.
and {C) diselose Plaintiffs expert witness. The Plaintiff disclosed an expert that he had
spoken to previously so that he would not he harred from engaging the services of same. The

Defendant made two major errors ofjudgment and practice aier this disclosure vt-as made.
The first error was to fail to communicate with t*laintift" s counsel before serving a notice ol`
deposition. Del`endant`s counsel knew full well that discovery was nowhere near complete
and assumed that this expert would not only be retained. but would be complete in his work
when a trial date in this matter had not even been set. if Defense counsel had called or
otherwise communicated with Plaintiff s counsel to arrange a mutual time for deposition as is
the standard practice. she would have learned that he was not yet retained and therefore did
not yet have any infonnation to oflier. The second cn·or was to tile yet another Motion for
Sanctions not only requesting tees for the improperly served notice ol` deposition, but tor
preparation of the lvtotion for Sanctions itsclf all of which could have been avoided by simple
and reasonable inquiry.
The disclosure by Plaintiff s counsel was not presented for any improper purpose. lt
was not objectively unreasonable tbr Plaintiff s counsel to disclose Richard Proctor as an
expert in the case. What was objectively unreasonable was for r‘tttorney Elaldini to fail to
contact PlaintiI`l"s counsel and acquire the essential facts of Dr. Proctor`s status and
knowledge ofthe case before noticing him for deposition. That failure was completely
unreasonable in light ofthe fact that discovery was still ongoing not to mention that the expert
is required to tile any and all reports with opposing counsel and to that date, the expert had
tiled nothing.
WHEREIJURE. the i’laintil`f respeetlitlly requests that this objection to Defendant’s lvlotion
for Sanctions be sustained.
