LOCAL RULE 9 C 1 STATEMEN
In support of its Motion for Partial Judgment on the Plead` gs and/or Partia Summary
Judgment, Plaintiff submits this statement of undisputed facts pur uant to Local Ru 9(c)(1): 1
1. On or about April 1, 2003, defendants Young and ensey jointly ex cuted a `
State of Comiecticut Superior Court Search and Seizure Warrant pplication. See ule 26(f)
Report at p.6, $[6, amiexed hereto as Exhibit (“Ex.") A. The wa rant application es not bear
a judicial signature and was never submitted to a judge for appro al. See Ex. A at p.7, II 8;
Fairfield Defendants’ Answer to the Complaint at 2, 1117. They nt the warrant a plication to
AOL via facsimile. See Ex. A at 6, 1I6. `
2. On April 7, 2003 AOI., responded to the warrant a plication by faxi g Mr.
Freedman’s subscriber information to defendants Young and Ben ey. See Ex. A a p.7, 1[10.
This information included Mr. Freedman’s name, address, phon numbers, accou tstatus,
