TO DISMISS PLAINTIFF’S COMPLAINT
Pursuant to Fed. R. Civ. P. l2(b)(1), l2(b)(6) and L. Civ. R. 7(a), Defendant I
Wachovia Securities, LLC, erroneously sued herein as Wachovia Bank, t7k/a Wheat First F
Union Securities, f/k/a First Union Corp. (hereinafter "Wachovia"), hereby moves to dismiss E
Plaintiffs Complaint in this action on the grounds that (i) this Court lacks jurisdiction over
the subject matter of the Complaint, and (ii) Plaintiff has failed to state a claim against
Wachovia upon which relief can be granted. Accordingly, Wachovia, the sole remaining `
Defendant, should be dismissed from this action. Wachovia has tiled a supporting _
Memorandum of Law herewith.
