1. Jack Dempsey’s, Inc. (hereinafter referred to s Jack Dempsey's) is a
onnecticut corporation doing business as Jack De·mpsey’ at 520 Success Avenue,
ridgeport, Connecticut. i
2. Jack Dempsey's operates a bar business and offe s live entertainment to the
ublic which is not defined as an "aduIt entertainment fac lity" as defined under the
ridgeport Zoning Regulations. {
3. Jack Dempsey’s has the desire to change its fo of live entertainment to

nclude the same type of dance performances sought by t e Plaintiff, Teddle’s Inc. .
"aduIt entertainment faciIity"). In the event that Jack Demp ey’s was unable to use its

resent premises for this purpose due to locational res rictions and Special Use
rovisions of the Bridgeport Zoning Regulations dealing with "a·dult entertainment

aciIities" Jack Dempsey’s would desire to find an alternativi location within the City of
Bridgeport. j
4. Jack Dempsey’s is subject to the same Zoning Re%uIations challenged by the
present Plaintiffs in this pending litigation, and is not located within a zone where an A
"adu|t entertainment faciiity" is a permitted use. _
5. The outcome ofthe litigation in this matter will dire tly affect John Dempsey's .
business and the rights secured to it by the First and Fourtee th Amendments to the
United States Constitution.
6. Ifthis motion is granted, Jack Dempsey’s would se? the same relief sought I
by the existing Plaintiffs in this litigation. j j
7. As to the existing Plaintiffs, Jack Dempsey’s , all q estions of law and fact are N
common to both entities. J
8. Counsel for Jack Dempsey’s consulted with couns I for the Defendants who
had an objection to the granting of this motion.
9. There would be no delay in this action in that Jack Dempsey’s would use the
same experts as noticed to the Defendants and all pending discovery is applicable to
Jack Dempsey’s. The pending Scheduling Order provides fo the joinder of parties by
December 10, 2003.
