We were served yesterday with Plaintiffs’ motion for a temporary restraining order and/or
preliminary injunction in the above matter. We do not think that Plaintiffs’ papers make a prima
facie case for such relief, because it is undisputed that the two Crew Leaders who were replaced
by subcontractors remain employed with Motmtaire. However, we are preparing a written
response to the motion, which we intend to tile by July 25, 2008. lf the Court wishes to conduct
