Plaiiitiffs Abbott iI.aboratories and Abbott Cardiovascular Systems, Inc.
respectfully move to enjoin Defendant Cordis Corporation ("Cordis") from prosecuting
Civil Action No. 07—02265, tiieci in the United States District Court for the District of
New Jersey on May I5, 2007 (the "New Jersey Action”).
In the New Jersey Action, Cordis asserts a ciairn against Abbott Laboratories
alleging infringernent of United States Patent No. '7,2l7,2.86. Cordis' patent infringement
ciaini in the New Jersey Action is related to and ctapticative of litigation already pending
before this Court in tiiis matter and in Civil Action No. 06—6i3—·SLR.l Accordingly,
Cordis should be enjoined tioni prosecuting the later-tiled dnpiicative Iitigation in New
Jersey.
I On May I5, 2007, in Civil Action No.06-6I.3-SLR, Piaintiffs moved to consolidate this
action, Civ. Nc. 07-259, with that related action. (Civ. No. 06-6I3—SLR, D.I. 43 .)

In Civil Action No. 06—6l3-SLR, Plaintiffs have tiled a motion that is
substantively equivalent to the present motion. (CA. No. 06-613-SLR, DI. 47.) Rather
than burden the Court with a duplicate set of supporting papers, Plaintiffs reiy on the
papers filed in support of the equivalent motion in Civil Action No. 06-613-SLR. (CA.
No. 06-613-SLR, D1. 48 (memorandum) 47 (proposed orcier).)
