PLEASE TAKE NOTICE that, pursuant to Rule 45 of the Federal Rules of Civil Procedure, Defendants and Counterclaim-Plaintiffs Teva Pharmaceuticals USA, Inc. ("Teva USA") and Teva Pharmaceutical Industries Ltd. ("Teva Ltd."), by their counsel, have served the accompanying subpoena for the deposition of Mr. Mark Chao. The subpoena commands Mr. Chao to testify, pursuant to Fed. R. Civ. P. 45, at the taking of his deposition in the above-named action. The deposition will take place on September 8, 2008 at 9:30 a.m., at the Crowne Plaza Chicago O'Hare, 5440 North River Road, Rosemont, IL 60018, or at such alternative date, time, and place as may be mutually agreed upon by counsel for Teva USA, Teva Ltd. and Mr. Chao.
