R. Civ.P., and Rule 54(b), Fed. R. Civ. P. 23 If these rules even apply to orders entered under Rule 32.2(c), Fed. R. Crim. P., Rule 24 54(b) certification would be unnecessary because there are no unresolved claims in this case. 25 And, to the extent that Rule 58, Fed. R. Civ. P., requires a separate document, our order 26 constitutes that document and the proposed order adds nothing to it. 27 28

At all events, Robert Johnson and Groupe Angelil have now filed a notice of appeal from our order and thus we believe their motion is now moot. IT IS THEREFORE ORDERED DENYING Robert Johnson's and Groupe Angelil's Rule 54(b) motion and Rule 58(d) motion on grounds of mootness (doc 268). DATED this 4th day of March, 2008.
