Dear Magistrate Judge Stark:
· We represent the Defendants, Plumbers and Pipeiitters Local #74 Pension Fund
. and GEM Group. I am writing in response to Your Honor’s letter dated January 8, 2008 and the
1 draft Scheduling Order provided to the parties.
Defendants have no objection to the proposed Scheduling Order. However, our
1 clients believe it would be prudent in this case if Your Honor were able to schedule and conduct
a mediation of this case in the near future. The Defendants believe that a prompt mediation
session will enable the parties to attempt to resolve this matter amicably without significant
judicial involvement.
Because Mr. Russo is not represented by counsel in this case, Defendants believe
that Your Honor’s skills and assistance in connection with a mediation would be helpful.
