OF ITS SECOND MOTION TO COMPEL
Plaintiffs Roche Diagnostics Operations, inc, and Corange International Ltd. (collectively
"Roche") hereby withdraw Roche’s Second Motion to Compel, filed June 13, 2008 (D,}. 208), as
to Nova Biomedical Corp. ("Nova"). After Roche tiled this motion, in continuing discussions
between Nova and Roche, Nova represented that it was not withholding documents responsive to
Roche’s Document Request Nos. 163-165 based on any objection other than privilege. In view
of Nova's representation, Roche agreed to withdraw the pending motion as to Nova.
Roche’s Second Motion to Cornpel as to the other defendants, Bayer HealthCare, LLC
and LifeScan, Inc. — who have maintained their refusal to produce the requested customer-
identifying infomation — is not impacted by this withdrawal, and therefore remains pending as to
those defendants.
