Pursuant to the COLl1‘I'S Order dated January 25, 2008, I am writing to provide an update
on the status of the above-referenced matter. The parties are in the process of finalizing and
documenting the settlement, and hope to be done in the next couple of weeks. As a result, the i
parties respectfully request that the Court allow the parties an additional 30 days to report to the
Court whether the case will proceed and a preliminary injunction hearing will need to be l
scheduled. 4
