APOTEX INCRS RULE 12(B)(2) MOTION TO DISMISS FOR LACK
OF PERSONAL JURISDICTION OR IN THE ALTERNATIVE
TO TRANSFER TO THE MIDDLE DISTRICT OF FLORIDA
Defendant Apotex Inc. hereby moves, pursuant to Fed. R. Civ. P. 12(b)(2), to dismiss the
Complaint tiled against it in this action for lack of personal jurisdiction. Apotex Inc. lacks
sufficient contacts with this forum to satisfy the requirements of Delaware’s long—arm statute or
the requirements of due process. Apotex Inc. isa Canadian corporation with virtually no
contacts in this State.
In the alternative, Apotex Inc. moves, pursuant to 28 USC. § 163I, to transfer this case
to the Middle District of Florida, where a related case is currently pending; where Apotex Inc.
has consented to personal jurisdiction for purposes of this case; and where Apotex Incfs
designated U.S. agent for purposes ofthe ANDA in suit is located.
A memorandum in support of this motion is tiled herewith.
