WHEREAS, Par Pharmaceutical, Inc. (“Par") tiled counterclaim counts IV and V on
January 31, 2008 in the above-captioned action;
WHEREAS, AstraZeneca Pharmaceuticals LP, AstraZeneca UK Limited, IPR
Pharmaceuticals, Inc., and Shionogi Seiyaku Kabushllci Keisha (collectively “AstraZeneca") have
not answered or otherwise served a pleading responsive to counterclaim counts IV and V;
WHEREAS, AstraZeneca has not iiled a motion for summary judgment; and
WHEREAS, AstraZeneca has not introduced evidence at a hearing or trial:
In accordance with Rules 4l(a) and 41(c) of the Federal Rules of Civil Procedure, Par
hereby voluntarily dismisses counterclaim counts IV and V in the abovemaptioned action without
preiudice.
