parties thereto, the arguments of counsel, and the applicable law, it is this __ day of

(1) That the Motion for Summary Judgment filed by Harbor be and hereby is granted;
(2) That the ruling of the Secretary of the Department of Health and Human Services be
and hereby is reversed and the Revised Notices of Final Settlement issued on October

(3) That the Leavitt Motion for Summary Judgment be and hereby is denied.
