The tmdersigncd represents defendant, Se-leeTruelts ofenneriea, LLC, in the ahove—referenced matter.
Plainti I`I`is represented by Rick Miller, Esquire. This matter is currently scheduled for a mediation with Your
llouor on September 19, EGGS and the parties are reqttired to submit their conlidential mediation statements by
September 5, EGGS.
l ant writing to advise Your I-loner that the parties believe that mediation will not he worthwhi Ie at this
tithe. Ill late Jtlly, the parties entered into settlement discussions. A settlement agreement was ultimately
reaelieti, however, shortly thereafter the plaintilf advised his attorney that he had second thoughts about settling
the case. Despite his cllbrts, plaintiffs counsel was unable to convince his eliettt to proceed forward with the
agreement. On August 4, EGGS, Mr. Miller tilerl a Motion to Withdraw as counsel for the plaintiff Detendant
filed a Motion to En force the Settlement Agreement on Aug ust ti, EGGS. By Order dated August E9, EGGS, the
Court denied the Motion to Withdraw and ordered plaintiff to respond to defendanfs Motion on or before
September 15, EGGS. Thus, in light of the pending Motion to Enforce the Settlement agreement, the patties
respectfully request that the September l9, EGGS mediation he canceled. Should the Court deny defendanfs
Motion, the patties may reconsider submitting the ease to mediation at a later date.
