I On or about December 26, 2007, in the District of Delaware, Carlos Gonzalez-Ortiz, the
defendant, an alien and subject of Guatemala, who had been removed to Guatemala from the United
States on or about.Apri1 4, 2003, was found in the United States and the defendant was knowingly in
- the United States, and prior to the defendant’s re~embarkation at a place outside the United States,
neither the Attorney General ofthe United States nor the Undersecretary for Border and Transportation I
Security, Department of Homeland Security, had expressly consented to the defendant’s re·application
for admission, in violation of Title 8, United States Code, Section l32(a). I

(a) cannot be located upon the exercise of due diligence; I
(b) has been transferred or sold to, or deposited with, a third party;
(c) has been placed beyond the jurisdiction ofthe court;
(d) has been substantially diminished in value; or
(e) has been commingled with other property which cannot be divided without difficulty;
it is the intent ofthe United States, pursuant to 21 U.S.C. § 853(p) as incorporated by 28 U.S.C. §
2461(c), to seek forfeiture of any other property of said defendant(s) up to the value cf the forfeitable
property described above.
