Defendant Watson Pharmaceuticals, inc., a Nevada corporation, by and through its
undersigned attorneys, respectfully moves pursuant to Fed. R. Civ. P. l2(b)(6) and (7) for entry
of` an order granting dismissal of all claims brought against it by Cephaion, Inc., and CIMA Labs,
Inc. (collectively, “Plaintiffs"), for failure to state a claim upon which relief can be granted, or
alternatively, for lack 0fi_joiuder of a necessary party. The grounds for this motion are set forth in
Watson Pharmaceuticals, Inc.’s Opening Brief In Support Of Motion To Dismiss Pursuant to
