On July 31, 2008, the Reorganized Debtors ("Appel1ees") filed their Reorgonized
Debtors’ Motion to Dismiss Appeal os Equitobly Moot [Docket No. 7] (the "1\/lotion to Dismiss")
and accompanying Opening Brief in Support of Reorgonized Debtors’ Motion to Dismiss Appeal
as Equitobly Moot [Docket No. 8] in support of the Motion to Dismiss. Appellant James W.
Korth tiled his Appellcznfs Response to Reorgctnizeci Debtors’ Motion to Dismiss Appeal as
Equitobly Moot [Docket No. 9] on or about August 15, 2008. On August 25, 2008, Appellees
filed their Reply Brief in Support of Reorgonized Debtors' Motion to Disrniss Appeal as
Equitobly Moot [Docket No. 10]. Accordingly, the Motion to Dismiss is now fully briefed.
Appellees respectfully request that oral argument be scheduled on the Motion to Dismiss at the
Court’s convenience pursuant to District of Delaware Local Rule 7.1.4 and Rule 8012 of the
Federal Rules of Bankruptcy Procedure.
