Petition to Revoke Supervised Release
COMES NOW PROBATION OFFICER Ernesto Hernandez presenting an official report on Luis
Omar Heras who was committed to the Bureau of Prisons on January 31, 2003, bythe Honorable James
A. Teilborg presiding in the District Court of Arizona. A concurrent period of supervised release (three
and five years respective as to Counts one, two, and three) was imposed, and supervision commenced
upon the offender's discharge from imprisonment on February 21, 2003. ln addition to the general terms
and conditions adopted by the court in General Order 05-36, the offender was ordered to comply with
the following special conditions:
1 . You shall submit to search of person, property, vehicles, business, and residence to be conducted
in a reasonable manner and at a reasonable time by, or at the direction of, the probation officer.
2. You shall provide the probation officer access to any requested financial information.
3. You are prohibited from owning, maintaining or using a firearm.
Luis Omar Heras was convicted of: Count 1: Bribery of Public Officials, in violation of 18 USC §
201(b)(‘l)(C), Ciass C felony; Count 2: Conspiracy to Import a Controlled Substance, in violation of 18
USC § 952(a), 960(b)(2) and 963, Class B felony; and Count 3: Importation of a Controlled Substance,
in violation of 21 USC § 952(ar), 980(b)(2), Class B felony and sentenced to 14 months imprisonment.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
A. VIOLATION OF STANDARD CONDITION 3: You shall report to the Probation Office as
directed by the Court or probation officer and shall submit a truthful and complete written
report within the first five days of each month.
Heras failed to submit monthly supervision reports for July, August, September, October,
_ November, and December 2005. Grade C violation §7B1 .1(a)(3).
B. VIOLATION OF STANDARD CONDITION 6: You shall work regularly at a lawful occupation
unless excused by the probation officer for schooling, training, or other acceptable
reasons.
Heras has failed to maintain stable employment throughout the term of supervision. Grade C
violation §7B1.1(a)(3).
