The defendant having denied the allegation as set forth in the supervised release violation
petition on May 8, 2006 and the defendant having submitted the matter of detention based on the
Pre—Trial Services Report, the Court having found reason to detain the defendant at the detention
hearing on May 9, 2006, and the Court having set a Preliminary Revocation Hearing on May 16,
2006 at 11:00 a.m. before Magistrate Judge Mathis-PHX, the Court finds as follows:
1. The defendant has not rebutted by clear and convincing evidence that he is not likely to
flee if released.
2 The defendant has failed to report to the probation ofhce since his release from custody
of the Bureau of prisons on March 24, 2006.
3. The defendant absconded from supervision.
IT IS THEREFORE ORDERED that the defendant remain in custody pending disposition.
