Pursuant to the terms of the Contract and tire Construction Performance
Bond, the City of Newark declares a Contractor default and nereby formally
terminates Donald Ni. Durkin Contracting, lncfs ("[ url contract for the Construction of the City of Newark Water Supply Reservoir. The .
termination is for cause due to Durkirre refueal to cor tplete the Work. This Default
nas been declared after notifying both the Surety and Ziurkin and attending a
conference with the Surety and Durkin as lite Bond ·eo_uiree. The City of Newark
hereby agrees to pay the Batance of the Contact lirice to the Surety in .
accordance with the terms ofthe Construction Contract or to a contractor selected
to compiete the Work in accordance with the terms of the contract with the City of
Newark.
The Surety is obligated to take one ofthe acetone enumerated in the Bond
promptly. Since the Surety has been aware ofthe ct errant issues with Durktn since
November 2003 and has had ample opportunity to a seeee the situation, the City of
Newark expects a response within t5 days of the da e or lxltie letter.
. The City of Newark provided written notice ci its intent to terminate Curkin '
on November 2t, 2003, thereby satisfying the notice requirements under Article 15
ofthe Contract in addition to satisfying the notice ra tuirertents under the Bond. it
is noted that the City of Newark has aieo complied wits the other termination
provisions of Article 15.
