On July 10, 2006, Erchonia Medical Inc., and Kevin Tucek (collectively referred to as "Erchonia") submitted their Report Re Patent Claims pursuant to the Court's Minute Entry Order dated June 30, 2006. During discussion between counsel following the

submission of that report, counsel has been advised that there is an ambiguity in the Report

regarding `096 Patent Claim 1 elements (b) and (g). Erchonia submits this Supplemental
6

Report to clarify their position with regard to these claim elements.

With regard to Claim 1 element (b), Erchonia asserts that this claim is literally

infringed, including infringement by equivalents within the meaning of 35 U.S.C. §112,

sixth paragraph. The reference to "doctrine of equivalents" in the initial report, rather than

equivalents under 35 U.S.C. §112, sixth paragraph with regard to this claim element was

inadvertent and is withdrawn. With regard to Claim 1 element (g), Erchonia asserts that this claim is literally infringed, including infringement by equivalents within the meaning of 35 U.S.C. §112, sixth paragraph. The reference to "doctrine of equivalents" in the initial report, rather than equivalents under 35 U.S.C. §112, sixth paragraph with regard to this claim element was also inadvertent and is withdrawn. Erchonia's counsel has discussed this supplemental report with opposing counsel, and opposing counsel has indicated that they have no objection to the filing of this supplemental report.
