Plaintiffs respectfully request that they be granted leave of Court to file a Memorandum of Points and Authorities in support of their Responses to (1) GTCR Defendants' Motion For Summary Judgment Regarding Fiduciary Duty And Other Remaining Claims, and (2) Makings' Motion For Summary Judgment On Contract Claims, Breach Of Fiduciary Duty, And All Other Claims, both of which exceed the 17-page limitation set forth in Rule 7.2(e), Rules of Practice of the United States District Court for the

District of Arizona. The Memorandum in support of the GTCR defendants' Motion was 41 pages in length, and the Makings Memorandum was 27 pages in length. To appropriately address the defendants' theories and the material facts requires memoranda in excess of the 17-page limit allowed by Rule 7.2(e). Accordingly, Plaintiffs respectfully request that the Court enter an Order granting the plaintiffs leave to file a Memorandum of Points and Authorities in support of their Responses to the Makings and GTCR Defendants' Motions for Summary Judgment as set forth herein.
