18 appeals to the United States Court of Appeals for the Ninth Circuit from (i) the Court’s Order of
IQ February 16, 2005 denying Plaintiff s relief requested in Count I of the First Amended Complaint
20 and granting Defendant Fortis Benefits Insurance Company summary judgment on Count I of the
2, First Amended Complaint; (ii) from that portion ofthe Court’s Final Judgment dated May 24, 2005,
22 and entered on June 2, 2005, which grants summaiy judgment in favor of Defendant Fortis Benefits
23 Insurance Company on Count I of the First Amended Complaint; and (iii) from the Court’s denial, by
24 Order dated March 24, 2005 and entered on March 31, 2005, of Plaintiffs Motion for
25 Reconsideration of the Court’s February I6, 2005 Order denying the relief requested by Plaintiff in
26 Count I of the First Amended Complaint.
