The undersigned hereby responds to the Court's Order to Show Cause of 5 May 2006 to explain why he explain why he has been appearing on behalf of Plaintiff but has not filed a notice of appearance with the Court. Counsel prepared the Notice of Appearance on 13 October 2005 in order to share a copy with Defendant's counsel and later, to file a copy with the Court via the scanner and word processor in the Clerk's office. He inadvertently failed to file the Notice, however, which mistake he did not realize until Defendant served him with a copy of the Motion for Summary Judgment via the U.S. Mail. Counsel profoundly regrets this oversight. A full e-mail account prevented his learning of the Court's Order until he received Defendant's Request for Clarification. (It is lamentable that Ms. Klepper felt the need to file her Request without speaking with the undersigned.) Nevertheless, it is appropriate to consider the Motion as timely and properly served. continues to hone his electronic-filing skills by, among other things, purchasing Cable Americafurnished e-mail and the necessary electronic-filing software less than a month ago, candor compels him to admit that he still struggles with the process and the necessity of checking his e-mail daily.
