The Court held two hearings on the matter on May 19, 2006. The Court will deny Defendant's Motion.

Pending before the Court is Plaintiff's Ex Parte Motion to Subpoena a Witness (Dkt. 151.) Pursuant to the discussions held on May 19, 2006, the Court denies Plaintiff's Motion as moot. Accordingly, the Court being fully advised, IT IS ORDERED DENYING Defendant's Motion to Continue Trial. (Dkt. 149). IT IS FURTHER ORDERED DENYING Plaintiff's Ex Parte Motion to Subpoena Witness.
