Defendant requests that the trial be continued to accommodate Defendant's principal witness's two month sabbatical with his family commencing June 1, 2006. Plaintiff argues that the trial should go ahead as scheduled because there will never be a trial date that will work out perfectly for everyone. The Court held two hearings on the matter on May 19, 2006. The Court will deny Defendant's Motion.

Pending before the Court is Plaintiff's Ex Parte Motion to Subpoena a Witness (Dkt. 151.) Pursuant to the discussions held on May 19, 2006, the Court denies Plaintiff's Motion as moot. Accordingly, the Court being fully advised, IT IS ORDERED DENYING Defendant's Motion to Continue Trial. (Dkt. 149). IT IS FURTHER ORDERED DENYING Plaintiff's Ex Parte Motion to Subpoena Witness.
