disclosed, nor is there any evidence of any fact which would render Mrs. Faiver liable to plaintiffs. Specifically, there is no evidence that she was an agent or officer of Correctional Health Resources, Inc. Thus, there is no evidence of any liability on the part of Mrs. Faiver for the actions or inactions of any officer or employee of Correctional Health Resources, Inc. Certainly, there is no evidence of any direct negligence on behalf of Mrs. Faiver. Accordingly, any discussion about Mrs. Faiver's liability would be unsupported by any evidence disclosed to date. It would, therefore, be irrelevant to discuss her during trial pursuant to Rule 401 and should be excluded pursuant to Rule 402. Additionally, discussion of Mrs. Faiver would tend to create confusion with the jury and result in confusion of the issues, misleading of the jury, and create undue delay and waste of time in breach of Rule 403 of the Federal Rules of Civil Procedure.
