Plaintiffs hereby respond to Defendants' Motion in Limine to Preclude the Individual

Claim of Rubecca Mikkelsen. Plaintiffs agree that Rubecca Mikkelsen is not asserting a

claim on her own behalf. Accordingly, Defendants' motion to preclude such a claim is moot. Plaintiffs want to make clear, however, the Rubecca Mikkelsen remains a proper plaintiff in her capacity as Personal Representative of the Estate of Kelly Mikkelsen for purposes of Plaintiffs' Section 1983 civil rights claim. Plaintiffs incorporate by this reference their response to Defendants' "Suggestion" regarding lack of jurisdiction and motion for remand. WHEREFORE, Plaintiffs respectfully request that this Court enter an order denying Defendants' motion as moot, since Plaintiff Rubecca Mikkelsen is not asserting a claim on her own behalf.
