Plaintiff BILTMORE ASSOCIATES, as Trustee for the Visitalk Creditors' Trust ("Plaintiff"), in accordance with the Order re: Trial Setting ("Order") hereby states counsel for Plaintiff and Counsel for Defendant Snell & Wilmer ("S&W") communicated regarding mediation but have not reached an agreement regarding whether to engage in a private or courtsponsored mediation. Plaintiff desires to engage in a court-sponsored mediation. S&W prefers to engage in a private mediation. Plaintiff has not received a response from Defendant Peter Thimmesch regarding this matter.

Plaintiff respectfully requests the court mediation to be held within 45 days from the date of the filing of this statement. S&W respectfully requests a private mediation be set within 45 days after the Court's ruling on Motions for Summary Judgment.
