undersigned counsel, stipulate and agree that the deadlines for the Response to Motion for Partial Summary Judgment by Snell & Wilmer, Response to Motion in Limine to Exclude Testimony of Renee Jenkins, or for Daubert Hearing and Response to Motion in Limine to Exclude Testimony of Boyd Lemon, or for Daubert Hearing be extended to July 19, 2007. The parties also agree that the date for the filing of S&W's Replies shall also be extended for a reciprocal 14 day period. Those motions raise numerous complex factual and legal issues which require additional time for Plaintiff to fairly and fully brief the matters. Also, lead counsel for Plaintiff, having the most complete knowledge of the

case, will be out of the office from June 29 through July 11, 2007. Therefore, an extension of time to respond to these motions is necessary and appropriate. None of the parties will be prejudiced by this extension and it will not impact the scheduled trial date of January 29, 2008. RESPECTFULLY SUBMITTED this 22nd day of June, 2007.
