Russell Holland) (Oral Argument Requested) Defendant Snell & Wilmer, LLP ("Snell & Wilmer"), by and through undersigned counsel, hereby moves the Court to strike Plaintiff's Response to Snell & Wilmer's Motion for Summary Judgment. The Response was untimely. After having received two extensions of time to respond, and after being specifically advised by the Court that no further extensions would be granted, plaintiff submitted a last-minute additional Motion for Extension of Time on Monday, July 23, 2007. The Court denied the Motion to Extend. As such, the Response, which was not submitted until July 24, 2007, is untimely and therefore should be stricken.
